'LEGAL COUNSEL' // UNDERSTANDING PRIVATE PLACEMENT PROGRAMS ('CHINA FUNDS')

Welcome back to our regular series of practical, "hands-on" articles exploring subjects of interest to fellow BradyNet Users.

Our intention is to help Users better understand the meaning and significance of various financial terms, processes and transactions that appear with all-too-frequent regularity on the Forum Board.

Release 86: Understanding Private Placement Programs - "China Funds"

Most everyone is familiar with the multi-billion dollar Proofs of Funds issued by Bank of China, Beijing. These bank statements are about as commonplace as a simmering dish of "bok choy chicken". And just as tantalizing!

A number of trade groups, meanwhile, have been talking up a blue streak about how they are currently trading Bank of China funds. These broker-types have the spiel down pat and are about as subtle as a train wreck. RIGHT!! Well, if they are trading China funds, I'll flap my arms and fly to Nantucket!

The truth is there has not been any trading on Mainland China accounts. Not one red cent, if you'll pardon the pun! These trade groups (and they keep popping up like bad pennies) love to run with the fantasy ball - but know this: They are lying to you. In Technicolor!

Take my advice and forget about Mainland China. Keep to the rest of the world. Anywhere but Mainland China! Why - because there is simply nothing going on there. Not with Bank of China funds. Not with heritage funds. Not with private funds. Not with U.S. Dollars, or Chinese Renminbi.

What you need to understand is this: All banks on the mainland fall under China's banking regulations. These regulations permit the issuance of SWIFT's, to be sure - but only for "standard" commerce. That's right, SWIFT's for investment purposes are not allowed. Not at all. And, by the way, this applies to "foreign" banks inside China as well.

So why, you ask, are there such restrictions on sending SWIFT's? Well, after the "Cultural Revolution" of the 1980's, a lot of China's managers wired money out of the country. For one reason or the other. THEN THEY FOLLOWED THE MONEY! That's right, they did a runner! Fleeing the country. In droves!

Needless to say, Beijing saw red (if you will pardon the pun again). To put a stop to this, the government reined in the banking laws, making the issuance of SWIFT's for non-commercial purposes illegal. So forget about Mainland China ever confirming accounts for private placement trading activity!

And, people, remember this: We are talking Beijing, China here - not Peoria, Illinois. You don't mess with the People's Armed Police Force! In China, financial crimes are punishable by death.

I work with very senior and credentialed principals in Europe and am the appointed Processing Director for the Sovereign and Genesis Programs - two extremely high-ranking Trade Programs that operates at the absolute pinnacle of this business. The 0128's and 502 funds are a waste time. Maybe things will change somme day. For now, i wouldn't waste the effort on China.

Hong Kong was, has been and will ALWAYS be part of China. Same applies to Tibet, Macau and Taiwan.

Having said that, China practises what no one else has tried or accomplished... One Country, Two Systems. Just google the term and you will have a better picture of the inter-connection with the seats of power between China and its Hong Koong SAR. There is a whole lists of common and different practises. Remember too, western banks there are mostly franchises, not a straight through process.

06-12-09 NISEAG: interesting but you post all opinion, no hard data, how about all the account statements printed and verified are for cpd (conto-pro-diverse) accounts which only exist 30 days and what about that bankers doing so are part of the deal and get kick backs outside the chinese jurisdiction, what about that Chinese Central Bank has a split SWIFT address which allows the local rep office to do direct linking up andonly clamps down on actal wires, not confirmations, because these have no value. I concure its a scam with real background, thats why people fall for it, but why not discuss the details?
