What does the alleged rape of a 14 year old girl have to do with an offshore financial transaction?

09-26-06  sapphirecapital: if the rape occured your banker would probably already be dead, the more reason to put someone on it as he obviously is not. The guys I know in Asia wouldn't think twice when something like rape of a family member would occur, they would definitely not settle for 10000. No amount of money would solve the question, the reaction would be immediate and final (I probably know the wrong people you will say), to me something is fishy here!

09-26-06  sapphirecapital: rgexim: you are right, choose with care and be extra careful in regards of social obligations. I wanted to convey however the concept taht when you deal with someone in business who is accused of a crime, there are certain point of views: a. if your deal in dangerous stuff it is inherent that you deal with dangerous people who can be borderline, so you have no reason to complain and play the moral argument b. if your first and always straight argument is morality before business, you better never deal with anyone of a bad repuation, considering it may be true. c. In between consider your options and be smart about it.

09-26-06  sapphirecapital: I have seen things like this, the low amount seems to speak for itself, however I can not talk about the realities here, the main thing is, the banker has shown a lack of judgement, in the US what he did can not be seen as <totally normal>. In a country such as the US which is completely selfemerged in its own values and dominated by a specific femal-male relation in the "legal arena" you need to exercise"good judgement" at all times and never be seen or be alone with a minor who is not your direct relative. Even if you appear rude, it does not ever work that way. If your banker is right that he has been taken for a ride, I suggest the engagement of a good detective to find out how often this has been orchestrated and what the backround is. As a bank I would definitely look at the banker as well.

09-26-06  Hotdog: Saphirecapital, you do bring up a very important point which illustrates why due diligence should be done in a proper quiet and professional manner and why it is important to understand the full story, the context of the story and not to be prejudicial without knowing the full story and all of the facts.

Let me explain why I chose to post this topic. I was called in by a banker friend and asked to do a favor quietly and quickly to preclude what could have been potentially an embarrassing situation for the bank. It had to be done outside of normal banking channels. What happened was this.

One of the bankers at the bank was invited to dinner at the home of a client, a gentlemen with an impeccable reputation. The banker accepted the invitation and attends the dinner. In addition to the client, the client’s wife and a friend of the client, the friends wife and thier 14 year old daughter were at the dinner.

As is normal during the progression of dinner from a purely social perspective the people explore what they have in common or whatever direction the dinner conversation goes in. About 10:p.m. the friend and his wife decide they want to go out for drinks and since the banker lived nearby them, would he be so kind to drop off thier daughter at home?. A perfectly innocent request on the surface. The banker says "sure, no problem!"

It's about an hour away between the place of the dinner and the home of the girl. As they are driving to the girls home in the car, the two of them have an engaging conversation on whatever subject. As they approach the home of the girl, the lights are out at the gate, so the girl asks would the banker walk her to do the door and make sure that she gets in o.k.?

Again, a reasonable request on the surface. The distance between the gate and the front door of the residence is within eyesight, not too close, yet not too far, but when it is dark it could seem farther then the distance really is. The two of the them walk to the door and as they get there, the 14 year old girl asks the banker if he is thirsty and would he like to come in and have a glass of water or something?. The banker accepts and ends up spending another hour or so at the home of the girl with just the two of them in the home.

The next day the banker gets a call from the client’s friend and is astonished to hear "You raped my daughter! What are you going to do about it?" "We don't want to go to the police".

Only the girl and the banker know what did or what did not happen between them. Was everything totally innocent or was there some inappropriate behavior or worse?

As you can imagine this was a very delicate mater. Was it an attempt to extort money from the bank or the banker, or did a statutory rape really occur as was alleged? What about the relationship with the client?

It's an unfortunate but true story that occurred, it was settled quietly by the banker and ended up costing him $ 10,000.00 plus legal fees.


09-25-06  sapphirecapital: I find the answers on the question completely off. Honestly I have no idea why you haunt each other, seems an absession. If you do not want to do business with each other than don't do it.

In regards to the question: A conviction for rape is a factor in the assessment of a man. That may not mean he can not get the business done, the question is more do you want to deal with him. In our network there are men with a dangerous reputation, they are considered to enforce their believes wether the state allows it or not, there are others who are people of faith and high morals; some mix some don't.

Before we allow someone in a network we do a backround check, he has to have a sponsor and it takes years to advance from associate to junior and later senior partner. A conviction for rape would make it difficult to be overcome in the process, I have not had such a case yet, but frankly we have had three who have been identified in more live threatening activities.

Personally I would not easily enter into a relation with a rapist and I would definitely read the file and define an opinion.

So my answer is yes, it would matter.

None of what you state is relevant to the topic and they certainly have no basis or foundation in fact that can be proven in a court of law. I do not engage in financial fraud of any kind in any way or in any shape or form. It is you that is perpetrating the fraud by falsely accusing me. What goverment order is it that you think that I am "disobeying".

What makes you think that I would even consider accepting $ 100,000.00 in pre closing costs from an unqualified party?. What don't you understand about the due diligence process that is mutual which would reveal a persons qualifications to engage in a transaction?.

You either are or are not a criminal. White collar crime will land you in prison too. When you defraud someone of 100K for your "preclosing costs", maybe they can't send their kid to college, and that girl ends up being a crack whore living on the street selling her body for money. A life destroyed by Mayer.

So its only direct crime that "horrifies" you, but taking some sap's money that he was going to use to pay for his wife's cancer treatment, thats no problem for you is it?

You are not better than a drug dealer, pedophile or politician. You wrap yourself in your "professionalism" but at the end of the day, you're just a low life fraud merchant, who would steal a man's last dying breath if you needed it.

Never preach here Mayer, everyone knows what you're really about.

Equally as vile and despicable are people like you who make false allegations against others that you know nothing about and have never done business with.

The topic has absolutely nothing to with the issue of pre closing costs, who pays them and when or on what basis.

You are such a moron that you totally ignore the entire point of the topic. It has nothing to do with me and everything to do with the issue of how and where to focus due diligence on an offshore transaction. Instead of being a f---ing coward and attacking someone while hiding behind a white sheer, why don’t you try answering the questions as they are asked and then we can have an intelligent discussion on the issues that are raised by the topic.
